TERMS AND CONDITIONS FOR ONLINE PURCHASES

Here are the terms and conditions under which you (the "Buyer") may purchase goods and services offered by Groupe BMTC Inc. ("Tanguay") on the Tanguay.ca website (the "Site"). If you do not accept these terms and conditions of purchase, you will not be able to purchase anything on the Site. Please read the following provisions carefully.

1. INTRODUCTION

The Buyer agrees to the terms and conditions set out below relating to the online purchase of goods and services offered on the Site.

2. USE OF THE "VIP PROFILE" ACCOUNT

The Buyer must create a "VIP profile" account on the Site before being able to place an order online. The Buyer is responsible for all orders placed on the Site through his "VIP profile" account. The Buyer agrees to keep the password to access his "VIP profile" account confidential and to notify Tanguay of any unauthorized use of said password within 24 hours. Tanguay does not protect the Buyer against the use of the Buyer's password linked to his "VIP profile" account.

3. REFUND AND EXCHANGE

All sales are final. However, if there is a problem with the purchased good existing at the time of delivery or if the good does not conform to the description given on the Site, the Buyer may, as soon as possible after receipt, return the good in its original condition and packaging to the following address: 7200, Armand Viau, Quebec (Quebec), G2C 2A7, accompanied by a copy of the invoice recording the purchase.

If circumstances warrant, Tanguay will apply its refund or exchange policy. In the event of a refund, the amount charged to the Purchaser's credit card by Tanguay for the purchase of the returned goods shall be credited as soon as possible. In case of exchange, Tanguay shall offer the Purchaser a product of the same nature and of an equal or higher cost.

4. PRICE

Tanguay Furniture makes every effort to maintain the lowest price on the items we sell, but price changes do occur, sometimes overnight. Therefore, the prices of items placed in your shopping cart are subject to change until you have placed a final order.

Please note that we reserve the right not to accept your order in the event of a pricing error or technical difficulties. In the rare event that your order is not accepted, you will be informed immediately and no charge will be made to your card.

Please also note that Tanguay Furniture promotions end at midnight Eastern time on the date indicated on the product and shopping cart pages.

5. TAXES

Tanguay calculates the taxes according to the address where the order will be shipped. Delivery can only be made to Quebec or New Brunswick. For an order delivered in Quebec, the taxes added will be QST (Quebec Sales Tax) and GST (Goods and Services Tax). For New Brunswick, the taxes added will be HST (Harmonized Sales Tax) and GST (Goods and Services Tax). The Buyer hereby acknowledges that for all tax exemption claims, purchases must be made in-store.

6. PAYMENT

Payment for purchases is made by credit card: American Express, MasterCard or Visa. Tanguay does not accept cheques or money orders. The proposed fees must be paid according to the payment procedure described during the registration process. The Buyer agrees to pay the total cost and charges associated with the product purchased, including taxes.

7. DELIVERY

Tanguay offers a home delivery service by truck or by mail, depending on the nature of the merchandise purchased and the delivery location. (https://www.tanguay.ca).

Tanguay will contact the Buyer to advise him of the expected delivery date of the ordered goods and the cost related to such delivery, if any. The expected delivery date is subject to change depending on the availability of the goods, the delivery address and due to circumstances beyond Tanguay's control, including weather conditions, failure of a supplier to meet delivery deadlines, mechanical breakdown, postal delays and other similar circumstances. For these reasons, Tanguay cannot be held responsible for failure to meet the initially scheduled delivery date.

If there is an unpaid balance at the time of delivery, the Buyer shall pay it in cash, by certified cheque or money order, failing which the merchandise shall be returned to Tanguay and kept there until full payment.

The signature of an adult (18 years and older) is required at the time of delivery. This person must accompany the delivery team inside the home.

The Buyer shall ensure that doorways, stairways and storage space are large enough to allow the delivery personnel to carry out their work without constraint.

The entrance to the Buyer's home must be clear and accessible at the time of delivery.

To avoid damage, the Buyer is recommended to protect the floor coverings of his home. For safety reasons, delivery personnel should keep their shoes or boots on.

If necessary, the only doors that delivery personnel are allowed to remove are those with hinged pins. Deliverers will unpack the goods at the time of delivery, except those marked "assembly required", which must be assembled by the Buyer. Deliverers will not install, connect or move any furniture or appliances. The Buyer must place his old mattress in the mattress cover at the time of purchase so that the delivery personnel can handle it. If Tanguay has to take back the Buyer's old appliances, they must be unplugged and removed from their place of use beforehand.

If a problem occurs at the time of delivery, the delivery personnel will inform the Buyer and ask him to sign a liability waiver or to return to the shop to select other items. Tanguay is not responsible for any personal effects left behind in the merchandise picked up by the delivery personnel.

8. INDEMNIFICATION

The Buyer agrees to indemnify, defend and hold harmless Tanguay and its suppliers from and against any and all liabilities, losses, claims and expenses arising out of the Buyer's breach of these terms and conditions or use of this Site.

9. CONFIDENTIALITY

The Buyer hereby certifies that it has consulted and agrees with Tanguay's privacy policy regarding the use of the Site and the use of the Buyer's personal information that may be collected by Tanguay as a result of the Buyer's visit to the Site, which privacy policy is available here, https://www.tanguay.ca/en/privacy-policy/

10. RECOGNITION

These terms and conditions, together with those incorporated or referred to herein, constitute the entire agreement between the Buyer and Tanguay with respect to their online relationship. IF YOU, THE BUYER, AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, please click the "I AGREE" button.
